Terms of Service

These Terms of Service (“Terms”) govern access to and use of the websites, Detailer Business System, onboarding, account configuration, automation, communications, website, support, and related services provided by Artivonix Solutions LLC, doing business as Wellmon Systems (“Wellmon Systems,” “Wellmon,” “we,” “us,” or “our”).

By purchasing, accessing, or using the services, you agree to these Terms on behalf of yourself and the business you represent.

If you do not agree, do not purchase or use the services.

1. Business Use and Eligibility

The services are intended for legitimate business use.

You represent that:

  • You are at least 18 years old
  • You have authority to accept these Terms
  • Information you provide is accurate
  • You will use the services only for lawful business purposes
  • You are authorized to act for the business connected to the account

2. The Detailer Business System

The Detailer Business System is a business-management system designed to help mobile detailing businesses manage activities such as:

  • Leads and contacts
  • Calendars and appointments
  • Customer communications
  • Reviews
  • Automations
  • Pipelines
  • Forms
  • Websites
  • Billing-related workflows
  • Business operations

Features may depend on account configuration, service-provider availability, messaging registration, integrations, subscription status, and third-party approval.

Access may be provided through the included LeadConnector mobile application and supported web interfaces.

3. Free Trial and Subscription

The standard Detailer Business System offer includes:

  • A 14-day free trial
  • A payment method collected at checkout
  • A $99 monthly subscription following the trial
  • No setup fee
  • Month-to-month billing

Unless canceled before the applicable renewal or trial conversion, the payment method connected to the subscription may be charged the recurring subscription amount.

Taxes, telecommunications usage, messaging usage, telephone charges, third-party charges, or other usage-based costs may apply where disclosed.

The current checkout page and written offer presented at purchase control if they differ from a general description on another page.

4. Onboarding and Account Configuration

Customers must complete requested onboarding steps, which may include:

  • Completing the setup form
  • Booking and attending an onboarding call
  • Providing accurate business information
  • Providing branding or website information
  • Authorizing requested integrations
  • Completing third-party verification or registration requirements

Account access may be provided during onboarding.

Wellmon Systems may continue remaining setup, configuration, quality-control, integration, website, messaging, or approval-related work after onboarding.

Delays caused by incomplete information, missed appointments, unavailable credentials, third-party reviews, domain access, customer actions, or external providers are not guaranteed to be resolved within the trial period.

5. Customer Responsibilities

You are responsible for:

  • The accuracy and legality of information placed in the system
  • Your services, pricing, estimates, invoices, taxes, policies, and customer promises
  • Maintaining secure account access
  • Controlling authorized users
  • Backing up or exporting records you need
  • Reviewing automations before relying on them
  • Monitoring customer communications
  • Maintaining required licenses and insurance
  • Complying with laws that apply to your business
  • Obtaining required consent for communications and data collection

Do not send Wellmon Systems passwords, verification codes, backup codes, complete card information, or banking credentials by email.

6. Communications Compliance

You are solely responsible for ensuring that calls, emails, text messages, automated communications, review requests, recordings, and marketing sent through your account comply with applicable law.

This includes obtaining required consent, honoring opt-out requests, using accurate sender information, maintaining required records, and following applicable telephone, text-message, email-marketing, privacy, and do-not-call requirements.

Wellmon Systems provides software and configuration tools but does not provide legal advice or independently verify that each communication is legally permitted.

7. Artificial Intelligence and Automated Output

The services may include artificial-intelligence features, automated recommendations, generated text, suggested replies, summaries, or other automated output.

Automated output may be inaccurate, incomplete, or unsuitable for a particular situation.

You are responsible for reviewing automated output before sending it to customers, changing business settings, making financial decisions, or relying on it for legal, tax, medical, safety, or professional purposes.

8. Payment Failures and Suspension

If a payment fails or an amount remains unpaid, we may:

  • Notify you
  • Retry payment
  • Apply a payment grace period
  • Limit or suspend account functionality
  • Disable connected services
  • Require payment of outstanding balances before restoration

Suspension does not automatically eliminate amounts already due.

Restoration may depend on successful payment, third-party availability, registration status, and completion of required account-review steps.

9. Pause Plan

Eligible customers may request the $25-per-month pause plan.

To begin the pause plan on an upcoming billing date, the request must be submitted at least 24 hours before the next scheduled charge.

Requests submitted within 24 hours of the next scheduled charge may begin on the following billing date.

The account is not considered paused until the subscription has been changed and the pause plan has been successfully activated.

While paused, account access, websites, automations, communications, telephone services, integrations, or other functions may be restricted or disabled.

The pause plan does not guarantee preservation of every telephone number, registration, integration, third-party connection, or external service.

10. Reactivation

Customers may request reactivation after pausing or canceling.

Reactivation may require:

  • A subscription change
  • A new checkout
  • Successful payment
  • Account review
  • Updated information
  • Reconnection of services
  • New messaging or telephone registration
  • Reauthorization of integrations

Previous settings may be restorable when available, but restoration of a particular number, website state, registration, integration, configuration, or third-party approval is not guaranteed.

11. Cancellation

Customers may request cancellation through the Wellmon Support Center.

For paid subscriptions, cancellation normally stops future renewal while access continues through the applicable paid service period, unless otherwise stated.

For trial subscriptions, timing may depend on when the cancellation request is received and processed.

Before final account access ends, customers are responsible for exporting any contacts, records, or information they wish to retain.

After final access ends:

  • Account access may be disabled
  • The customer website may be taken offline
  • Automations and services may stop
  • Export access may no longer be available
  • Telephone-number availability is not guaranteed
  • Messaging registrations and integrations may no longer remain active

Customer-owned domains remain the property of the customer.

Cancellation does not eliminate outstanding telecommunications, messaging, usage, third-party, or other charges already incurred.

Information may be retained internally for legal, security, billing, restoration, and operational purposes.

12. Refunds

Refund eligibility, if any, is controlled by applicable law and any written refund terms expressly presented by Wellmon Systems at the time of purchase.

Canceling a subscription does not automatically create a refund for a completed billing period, usage charge, third-party charge, or service already provided.

13. Acceptable Use

You may not use the services to:

  • Violate applicable law
  • Send unlawful spam, calls, or text messages
  • Mislead, impersonate, harass, threaten, or defraud others
  • Collect information without appropriate authority
  • Upload malware or malicious code
  • Attempt unauthorized access
  • Interfere with service operation
  • Circumvent security or usage restrictions
  • Infringe intellectual-property or privacy rights
  • Operate illegal, deceptive, abusive, or prohibited activities
  • Resell or sublicense the service without written permission

We may restrict or suspend activity that creates legal, security, reputational, operational, or platform risk.

14. Customer Content and Data

You retain ownership of business content and Customer Data you lawfully provide.

You grant Wellmon Systems and its service providers permission to host, process, transmit, display, modify, and use that information only as reasonably necessary to:

  • Provide the services
  • Complete requested configuration
  • Operate integrations
  • Provide support
  • Protect the system
  • Comply with law
  • Enforce these Terms

You represent that you have the rights and permissions necessary to provide and use the information.

15. Wellmon Systems Intellectual Property

Wellmon Systems retains all rights in its:

  • Branding
  • Logos
  • Documentation
  • Training
  • Templates
  • Workflows
  • System architecture
  • Software configuration methods
  • Website designs
  • Processes
  • Written materials
  • Proprietary business materials

Your subscription provides a limited, revocable, nonexclusive right to use the services during the active subscription period.

It does not transfer ownership of Wellmon Systems intellectual property.

16. Third-Party Services

The services rely on third-party platforms and providers.

Third-party services may modify features, experience downtime, reject registrations, change pricing, impose restrictions, or discontinue functionality.

Wellmon Systems does not control third-party platforms and cannot guarantee uninterrupted availability or approval by those providers.

Your use of third-party services may also be subject to their separate terms and privacy policies.

17. Service Changes and Availability

We may update, replace, limit, or discontinue features as reasonably necessary for:

  • Security
  • Legal compliance
  • Platform changes
  • Product improvement
  • Vendor availability
  • Account safety
  • Operational requirements

We do not guarantee that the services will be uninterrupted, error-free, or available at every time or location.

18. No Guarantee of Business Results

Wellmon Systems does not guarantee:

  • Revenue
  • Profit
  • Leads
  • Bookings
  • Reviews
  • Customer retention
  • Search-engine placement
  • Advertising performance
  • Messaging approval
  • Telephone-number availability
  • Integration approval
  • Any particular business result

Results depend on factors including the customer’s offer, market, pricing, sales activity, service quality, reputation, follow-up, advertising, compliance, and use of the system.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the services are provided on an “as is” and “as available” basis.

Wellmon Systems disclaims warranties that are not expressly stated in writing, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

20. Limitation of Liability

To the fullest extent permitted by law, Wellmon Systems will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost opportunities, lost data, loss of goodwill, or business interruption arising from the services.

Wellmon Systems is not responsible for losses caused by:

  • Customer actions
  • Incorrect customer information
  • Unauthorized account access
  • Third-party platforms
  • Messaging or telephone providers
  • Payment processors
  • Internet or hosting outages
  • Customer communications
  • Legal noncompliance by the customer
  • Failure to export or back up records
  • Third-party rejection or suspension

Nothing in these Terms limits liability where limitation is prohibited by law.

21. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Artivonix Solutions LLC, Wellmon Systems, and their owners, employees, contractors, and service providers from claims, losses, liabilities, costs, and expenses arising from:

  • Your misuse of the services
  • Your Customer Data or content
  • Your communications with leads or customers
  • Your violation of law
  • Your violation of these Terms
  • Your infringement of another person’s rights

22. Termination

We may suspend or terminate access if you:

  • Fail to pay amounts due
  • Materially violate these Terms
  • Create security or platform risk
  • Use the services unlawfully
  • Abuse staff, providers, or systems
  • Cause a third-party provider to restrict the account
  • Engage in fraudulent or deceptive conduct

Termination does not eliminate obligations or charges that arose before termination.

23. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles, except where applicable law requires otherwise.

24. Severability

If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

25. No Waiver

Failure to enforce a provision does not waive the right to enforce it later.

26. Changes to These Terms

We may update these Terms to reflect changes in our services, vendors, business practices, or legal obligations.

The updated effective date will be posted on this page.

Where required, we will provide additional notice before material changes take effect.
